1. Who you are booking with
All bookings placed and paid through VamosDay.com for activities in Málaga, Sevilla and Valencia are sold directly by PLAYDAY S.L. (NIF B16375578), Calle Ángel Ganivet, 1, 29005 Málaga, Spain; toppsegway@gmail.com; +34 643 25 83 44. We do not act as a marketplace for third-party excursion organisers in these booking flows.
2. Booking process and payment
Before placing an order, customers can review the activity description, meeting point, date, time, number of participants, price and any specific requirements. Online consumer bookings are paid in full at the time of booking through the available secure payment methods. A booking is confirmed once payment has been successfully processed and the booking confirmation is issued to the email address supplied. Please check the confirmation and notify us promptly of any errors. For corporate or private groups, a deposit or different payment timetable may be agreed explicitly in a written quotation or contract.
3. Prices and inclusions
The final price, including applicable taxes and any disclosed charges, is shown before payment. Items included in each experience are described on its product page. Transport to the meeting point and other extras are not included unless expressly stated.
4. Customer cancellations and refunds
Boat and catamaran trips: free cancellation up to 48 hours before the scheduled start time, with a full refund of the amount paid. Departures are also subject to weather and sea conditions (see section 7).
Walking, tapas and Segway tours, and all other activities: free cancellation up to 24 hours before the scheduled start time, with a full refund of the amount paid.
The deadline is calculated using the local time at the destination and the scheduled start time stated in the confirmation. To cancel, contact us at toppsegway@gmail.com or +34 643 25 83 44, identifying your booking.
Cancellation after the deadline: no contractual refund is due, without prejudice to mandatory legal rights, the force majeure rule below or any exceptional arrangement expressly confirmed by us.
Force majeure: if you cannot attend because of an event outside your control that you could not reasonably foresee or avoid (for example, a cruise ship that is unable to dock in Valencia), you will receive a 100% refund of the amount paid, regardless of how much notice you give. Please contact us as soon as possible with details of the event.
Where a refund is due, it will be made to the original payment method, normally within 14 calendar days of confirmation of cancellation; bank and payment provider settlement times may vary.
5. Changing the date
We accept requests to reschedule at any time before the activity begins, including last-minute requests. Changes are subject to available places and operational feasibility. We will offer alternative dates or times if the preferred option is unavailable. A date change is not an automatic entitlement to a refund for a late cancellation or a no-show. Any agreed change will be confirmed using the customer’s contact details.
6. Late arrival and non-attendance
Please arrive at the meeting point at the time specified in your booking confirmation, allowing enough time for check-in and the mandatory safety briefing. An arrival that prevents safe or timely participation may be treated as a no-show. No-shows are not refunded, subject to mandatory consumer rights. If you are running late, contact us as soon as possible; we will try to help but cannot guarantee departure will be delayed.
7. Adverse weather and changes by VamosDay
For safety or operational reasons (including unsuitable weather), PLAYDAY S.L. may postpone, change or cancel an activity. If we cancel it or cannot provide a suitable replacement, you may choose a new available date or a full refund for the affected service. We will contact you using the details provided during booking. Necessary minor route changes that do not materially alter the purchased service do not, by themselves, trigger a refund; your statutory rights remain unaffected.
8. Age, weight and participation requirements
Segway: minimum age 10 years; participant weight 25–125 kg, inclusive. Games: generally 6–99 years, unless an individual product page states a different requirement. Other activities (including e-bike and water-based experiences) have their own minimum ages, physical requirements and safety rules, which must be checked before booking. Age and weight conditions are safety requirements, not recommendations.
Children must be accompanied by a parent or legal guardian as required for the activity; the accompanying adult remains responsible for their supervision. Before a tour or game, the organiser may require the accompanying adult and participants to read and sign a participation and safety acknowledgement. Signing does not waive statutory consumer rights or liability that cannot be excluded by law.
Activities involving personal mobility or physical risk, particularly Segway riding, are not suitable during pregnancy or where serious medical or mobility conditions prevent safe participation. Customers should consult us before booking if they are unsure whether the activity is appropriate. We aim to assess accessibility and reasonable alternatives individually where safe and practicable. Participants must follow the guide’s instructions, wear any required protective equipment, and must not take part under the influence of alcohol or drugs. The guide may stop unsafe participation to protect the group, subject to applicable law.
9. Insurance
PLAYDAY S.L. maintains civil liability insurance with Lloyd’s Insurance Company S.A. and collective accident insurance with Helvetia Compañía Suiza, Sociedad Anónima de Seguros y Reaseguros for activities covered by the respective policies. The insurance applicable to an activity is subject to the terms, geographical scope, limits and exclusions of the relevant policy. Participants must follow safety instructions and may request information about the applicable insurance at toppsegway@gmail.com. Nothing in this section limits any non-excludable consumer rights or legal liability.
10. Gift cards
VamosDay gift cards are valid for 24 months from issue. The recipient may redeem the voucher for an available eligible experience, subject to the voucher value, availability and the age/safety rules of the selected activity. If the experience costs more than the available voucher balance, any additional amount is shown before booking. Cancellation of an activity booked with a gift card follows these activity booking terms, with any eligible refund normally returned to the voucher or equivalent original value unless the law requires otherwise. Gift-card purchase cancellations and refunds are subject to the applicable statutory rights, which may differ from the rules for dated leisure activities; contact toppsegway@gmail.com before the voucher is redeemed.
11. Statutory withdrawal rights
For leisure services booked for a specific date or period, the general 14-day statutory withdrawal right generally does not apply under Article 103(l) of Spanish Royal Legislative Decree 1/2007. Our voluntary 24-hour cancellation policy in section 4 remains available. This exception must not be applied automatically to an unredeemed, undated gift voucher; mandatory rights applicable to that purchase continue to apply.
12. Customer communications and privacy
We use the contact details supplied for confirmation, meeting-point instructions and necessary changes. We may send an individual post-activity request for feedback and practical local recommendations; we do not add customers to marketing newsletters without a separate lawful basis. For details, see our Privacy Policy.
13. Complaints, applicable law and changes
Customer support and complaints: toppsegway@gmail.com, +34 643 25 83 44 or postal mail to our registered office. Consumer complaint forms are available in accordance with applicable Andalusian and Spanish law. Spanish law applies subject to mandatory consumer protection rules; no clause restricts consumers’ legally available forums. The terms accepted at the time of booking apply to that booking; subsequent website changes do not retroactively alter confirmed bookings.
